Peg Arguimbau Chairman, Stephen Cremer, Elizabeth McGrath, and Keevin Geller were the members present. Conservation Commission Members, Hank Langstroth and Christine Turnbull were absent
from the meeting. The Conservation Administrator, Greg Meister, was also present.

7:45 p.m.:  A Notice of Intent hearing continuance for Joseph and Gina Mazzotta for the proposed construction of a single-family dwelling and associated utilities and site work at 257 South Walpole Street,
DEP File #SE-280-0525:

Present: Applicants - Joseph & Gina Mazzotta. Engineer - Rick Merrikin, Merrikin Engineering.
Rick Merrikin appeared before the Commission to represent the Applicants and submitted revised plans dated 8/10/11 for the proposed project. Rick explained to the Commission that he recently met with the Conservation Administrator on the proposed project site to review the proposed Conservation Restriction Line and the wetland line delineation previously submitted on the original plans. The modifications recommended by the Conservation Administrator regarding the delineated wetland line for the proposed project are included on the revised plans submitted to the Commission. Rick explained to the Commission that a few of the revised wetland flags were moved approximately 10 feet for the proposed project. The proposed Conservation Restriction Line delineated by the Conservation Administrator is also depicted on the submitted revised plans.
The members of the Commission approved the proposed revisions to the delineated wetland line and the proposed Conservation Restriction Line concerning the proposed project.
The Commission agreed to approve the Applicant’s proposed revised plans with the following conditions:
  • The proposed driveway installation on Lot 2 shall consist of porous paving material.
  • The Applicant shall fully execute and record the proposed Conservation Restriction on
      Lots 1, 2 & 3 within 90 days.
Peg called for a motion to close the hearing and to issue the Order of Conditions to the Applicants with
the conditions as discussed.
Stephen Cremer moved. Elizabeth McGrath seconded. Voted. Unanimous. 4-0-0.

8:00 p.m.:  A Notice of Intent public hearing filed by Charles Dow for the proposed construction of a
single-family dwelling and associated utilities and site work at 7 Castle Drive, Subdivision Lot 17,
DEP File #SE-280-0526:  

Present: Representing the proposed Applicant - Steven Gioiosa from SITEC; David Wluka- Realtor.
             Builder for the Applicant’s proposed project - Ernst Polyak.
             Michelle Krolick, 4 Knob Hill St.; Jeff Grosser, 58 Orchard Hill Dr.- Potential buyers of the Lot.

Steven Gioiosa presented a proposed plan to the Commission entitled, “Subsurface Sewage Disposal System Plot Plan,” 8/10/11, last revised date, and the green Abutter cards. He explained to the Commission that the proposed project is for the construction of a single-family residence with
associated utilities and grading. This lot is part of a subdivision that was approved back in the 1970s (Sharon Highlands). This proposal is a result of a settlement between the Town and Bay Road Woodland
Trust. Modifications made to the proposed plan were previously suggested by the Conservation Administrator and the DEP. The Applicant accepted those modifications that included the use of
retaining walls to decrease the limit of work inside the buffer zone and the wetland crossing. The square footage of the wetland alteration areas was decreased and 180 s.f. of wetland replication was added to the Applicant’s proposed plan. The discussion then centered on the method by which the proposed septic line would be installed beneath the brook.
The members of the Commission approved the Applicant’s proposed revised plan solely subject to the M.G.L. Ch. 131 § 40 State of Massachusetts Wetlands Protection Act.

The Commission agreed to issue the Order of Conditions to the Applicant with the following conditions:
  • The Applicant shall install a 20 foot crushed stone apron off Castle Drive where construction    
            equipment will be accessing the lot.  
  • A wetland scientist shall submit a wetland species planting plan to the Sharon Conservation  
            Commission and said wetland scientist shall directly supervise the installation.
Peg called for a motion to close the hearing and to issue the Order of Conditions to the Applicant with the
conditions as discussed.
Stephen Cremer moved. Keevin Geller seconded. Voted. Unanimous 4-0-0.

8:15 p.m.:  A Notice of Intent public hearing filed by Nir Davidson for the proposed addition within
the 100 Buffer Zone at 192 Wolomolopoag Street:

Present: Applicant - Nir Davidson. Applicant’s Representative -Larry Trim, 2 Fairway Drive,
Barrington, Rhode Island.
Larry Trim appeared before the Commission to represent the Applicant. He submitted
a proposed plan entitled, “Proposed Addition to 192 Wolomolopoag Street, Sharon, MA”,
8/10/11 last revised date. He also submitted the certificates of mailing regarding the notification to abutters concerning the proposed project.
The following is the scope of the proposed project:
  • The proposed construction of an addition in the rear of an existing single-family home includes
      the installation of a foundation within the footprint of an existing deck.
  • There is no tree clearing work proposed for the project.
  • The project is being proposed within the previous existing lawn area of the site.
  • The existing driveway on the site will not be increased from the proposed project.
  • The proposed project involves minimal excavation work and any excavated material will be
           stockpiled on the existing driveway of the project site.
The Commission approved the Applicant’s proposed project with the following conditions:
  • The proposed addition shall not encroach any closer to the wetlands on the site than the existing footprint of the deck.
  • The haybales shall be installed at the edge of the rear lawn area of the proposed site during construction of the proposed project.
Peg called for a motion to close the hearing pending receipt of the DEP file number and to issue the
Order of Conditions to the Applicant with the conditions as discussed.
Keevin Geller moved. Elizabeth McGrath seconded. Voted. Unanimous. 4-0-0.

8:30 p.m.:  A Notice of Intent filed by Norman Boucher & Kathryn Sky-Peck for the proposed rear
2-story addition with a garage underneath and a 1-1/2 story front addition at 15 Samoset Lane,
DEP File # SE-280-0527:
Present: Applicants - Norman Boucher and Kathryn Sky-Peck.
             Abutters - Barton and Gayle Fink, 9 Samoset Lane.
            Applicant’s Architect - Henry Bobek from Signature Designs.
Henry Bobek appeared before the Commission to represent the Applicant and submitted the certificates
of mailing regarding the notification to abutters and the following proposed plans:
  •   “Proposed Plot Plan, 15 Samoset Lane, Sharon, MA” Dated 7/1/11.
  • “Proposed & Existing Floor Plans, Boucher/Sky-Peck Residence, 15 Samoset Lane, Sharon, MA”
Dated 7/1/11.
Henry Bobek explained to the Commission that approximately 18.5 feet is the closest point of the
existing foundation to the wetlands on the proposed project site. The proposed plans conform to the existing precedence of the Town’s Bylaws. The Applicant is planning to meet with the Planning Board in September.
The abutters at 9 Samoset Lane expressed their concern about drainage from the proposed constructed driveway affecting their property.

Mr. Bobek indicated that any drainage from the proposed constructed driveway would flow in the direction to the rear of the lot.
The Commission recommended the installation of porous pavement and a stone apron at the bottom of the proposed constructed driveway.
Stephen Cremer recommended that some topo lines on Abutter Fink’s side of the lot be delineated on a revised plan submitted to the Commission.
Peg called for a motion to continue the hearing until September 1 at 7:45 p.m.
